YPEN: Next steps for the regulation of category 5 unauthorized constructions

The Deputy Minister of Environment and Energy, Nikolaos Tagaras, left open the possibility of re-examining the issue of the regularization of Category 5 unauthorized constructions within a broader, revised institutional framework, in response to a topical question submitted by Georgios Vlachos, Member of Parliament for Eastern Attica (First District) of the New Democracy Parliamentary Group.

Category 5, which presents particular legal and urban planning complexities, includes buildings with violations exceeding 40%, thereby creating obstacles to property transfers and other transactions. For this category, the possibility of regularizing unauthorized buildings or unauthorized changes of use expired in 2020.

The primary policy direction is the transition from a regime of repeated extensions and fragmented arrangements to a system characterized by clear rules, substantive controls, and institutional stability. Within this framework, the eligibility period for specific categories of property owners—such as investment funds and banks—expired on 31 December 2025, without any further extension, demonstrating the intention to limit exceptions and the continuous prolongation of deadlines.

For the remaining Categories 1 to 4, extensions have been granted, which are currently set to expire in 2028.

According to the Deputy Minister, significant institutional and technical reforms are currently underway that will comprehensively affect the framework governing development management. These include the preparation of Local and Special Urban Plans, the delineation of settlements and road networks, the establishment of a new enforcement mechanism for unauthorized constructions, the implementation of the Electronic Building Identity system, a new procedure for issuing building permits, and the restructuring of Building Services under a revised institutional framework.

All these interventions are interconnected and must either be completed or reach a sufficiently advanced stage to provide a clear and comprehensive overview before definitive decisions are taken regarding Category 5 unauthorized constructions.
