As provided by Law 5092/2024 regarding the economic and touristic utilization of beaches, specific limits are established to protect their public character:
The concession may not exceed 50% of the total area of each beach, a percentage reduced to 30% in Natura areas.
The maximum area per concession is 500 square meters.
The placement of equipment (umbrellas, sunbeds, etc.) is permitted on up to 60% of the concession area – and up to 30% in Natura zones.
A minimum distance of 6 meters is required between separate concession areas.
Concession is completely prohibited when the beach has a width or length of less than 4 meters, or a total area of less than 150 square meters.
Concession holders must fulfill specific obligations to ensure public service and environmental protection:
- Unobstructed access for all, with special provision for persons with disabilities or mobility issues.
- Daily cleaning of the concession area.
- Display of a sign with concession details, QR code, and information about the rights of beachgoers.
- Installation of hygiene infrastructure, such as showers and changing rooms.
- Protection of the natural environment, maintaining the natural form of the coastline.
- Presence of a lifeguard and installation of seatrack systems, if not provided by the local municipality.
- Removal of equipment at the end of the summer season or upon expiration of the contract, and restoration of the area to its original condition.
In cases of non-compliance with the above obligations or violation of the contract terms, the concession may be revoked without compensation.
For unauthorized occupation of a beach, a fine equal to four times the stipulated fee is imposed, and the business is ordered to close within 24 hours.
If the approved concession area is exceeded, the fine corresponds to four times the applicable fee for the excess area.
When a private property lies between the public road and the beach, the owner or holder is obliged to ensure free and safe passage, in accordance with urban planning legislation.
Obstruction of access is punishable by a fine ranging from €2,000 to €60,000.
