Positive developments for the expansions of Attiki Odos

The draft bill presented at last Friday's (January 10, 2025) Cabinet meeting by Minister of Infrastructure and Transport Christos Staikouras and Deputy Minister for Infrastructure Nikos Tachiaos aims to clarify the gray areas in the regulatory framework governing "standard proposals."

The goal is to achieve the most efficient application of the standard proposal framework, with the ultimate aim of accelerating the maturity, tendering, and implementation of significant infrastructure projects with the involvement of the private sector.

The "Standard Proposal," established by Law 4903/2022 (A/46), pertains to the tendering and construction of infrastructure projects or the provision of related services, with a budget exceeding €200 million.

The law allows private investors and contractors to propose the implementation of an infrastructure project to the Ministry by submitting a study that includes cost estimates, financing, a timeline, and exploitation plans for the project.

If the proposal is deemed technically sound and complete, the relevant authorities proceed with an open tender. Should the proposing investor not win the contract, they are compensated for the study they submitted.

New provisions clarify issues arising both during the submission process and the evaluation of "standard proposals," which can now only be submitted for concession contracts or Public-Private Partnerships (PPP).

At the same time, regulations are set for the formation of the Evaluation Committee for Standard Proposals.

Specifically, the electronic platform on which standard proposals must be submitted is defined, the process for the payment and refund of fees in case of proposal rejection is streamlined, and the composition of the "Standard Proposals Evaluation Committee" is modified. Ministers of Infrastructure and Environment will no longer participate; instead, the relevant General Secretaries will take part.

To date, the Ministry has received a "Standard Proposal" for the three extensions of Attiki Odos from the consortium GEK TERNA (36%) - Aktor Concessions (32%) - Avax (32%) and for the axis connecting Elefsina to Oinofyta (GEK TERNA).
