Engineer's certificates on the non-existence of arbitrariness are valid

The Engineer's certificates regarding the non-existence of arbitrariness are valid for a two-month period, until the Ministerial Decision for the mandatory application of the Electronic Building Identity, according to a recent update of the Notary Association of Athens Piraeus Aegean & Dodecanese.

For example, even if on 30.01.2021 it is published in the Official Gazette and the validity of the relevant Ministerial Decision begins, all Certificates of Law 4495/2017 with an autopsy date of 29.01.2021 are valid for two (2) months, ie until 29.03.2021 .
 
It is reminded that the Building Identity was activated on 1.1.2021, with the TCG as the platform's administrator, and a reciprocal fee of € 20 for each certificate.
 
All buildings and stand-alone properties (mainly residential buildings, offices and shops) except those of public interest, must submit the required Building Identity information upon their first transfer. For buildings of public interest (eg buildings that house all kinds of public services, local authorities and legal entities under public law, tourist accommodation over 300 sq.m. schools, hospitals, theaters, museums, etc.) the identity details of the building must be submitted within five years ( until 31.12.2025).
 
The declaration of Building Identity is made per building or per divided property. The authorized engineer, who fills in the details of the Electronic Identity of the Building or the divided property, is appointed by the owner for each building or divided property.
 
The required documents are:
 
 a) the building permit of the building, along with any revisions,
 
 b) the plans that accompany the building permit, as well as the study of accessibility of disabled persons, if required. If the building permit and the accompanying data are not found in the records of the relevant service, a certificate of loss is submitted instead by the competent Building Service.

 (c) the energy performance certificate of the building or parts thereof;

 (d) the construction inspection certificate, if issued;
 
 e) declarations of submission to laws suspending the imposition of sanctions on arbitrary buildings;
 
 (f) floor plans showing the building in its actual condition, where it does not appear from the details of items a, b and e;
 
 g) the structural vulnerability sheet or the technical report of static control, which accompanies the application for inclusion in law 4178/2013 (A` 174) or the present (L.4495 / 17) or the static adequacy study, if required, in accordance with Article 99
 
 h) the table of millimeters or the study of distribution of costs of the building, if any.
 
i) the deed
 
j) copy of the cadastral sheet
 
In the next transfers, the engineer appointed by the owner, will issue the Certificate of Completeness, which will confirm that there are no arbitrary changes in this property, or that the Building Identity has been informed if a building permit or small-scale work has been mediated for performing work on this property. In new constructions, the Building ID will be issued together with their building permit.
