As outlined in a recent announcement, in order to prevent the creation of faits accomplis and deadlocks and pending the publication of the Council of State (CoS) decision, on which a statement was issued by its President on 11.12.2024, the Ministry has submitted an urgent transitional provision for voting in Parliament. The provision includes the following measures:
Suspension of pre-approvals and new building permits that utilize:
- The provisions of the Building Code that provide incentives for increasing building conditions (articles 10, 15 par. 8, 19 par. 2, and 25).
- The non-counting of certain areas in the building coefficient according to paragraph 6 of article 11 of Law 4067/2012, including internal balconies (patios), the main use area of 35 sq.m. on the roof, and the simulated swimming pool with a planted surface (paragraph 2 of article 19 of Law 4067/2012).
Suspension of urban planning councils’ meetings regarding issues involving the application of these incentives, to ensure equal treatment of citizens' requests. This suspension will remain in effect until the relevant decision is published.
If a legislative initiative or new regulations are required to align with the Council of State's decision, both suspensions – of the issuance of pre-approvals and new building permits, and the meetings of urban planning councils – may be extended by the Minister of Environment and Energy for a period not exceeding one month from the publication of the CoS decision.
- Building permits already issued using these incentives will not be revoked by the Administration until the CoS decision is published. Any revocation of permits issued after 11.12.2024, due to the use of these incentives, will be automatically invalid.
